We at MMS, Inc. (“us,” “our” “we,” or “Company”) believe it is important to let you know how we collect, use and disclose personal information about you.  We reserve the right to modify this Privacy Statement at any time without notice (for example, if we modify our practices regarding the collection or use of information).  We list the last revision date of this Privacy Statement below.

Information Collection

  • We may receive your name, email address, physical address, and other professional and personal information from licensed databases such as the American Medical Association Physician Professional Database (“AMA PPD”) and other similar databases or list owners, data compilers or directories.

  • We may collect any information that you have voluntarily submitted to us or to a third party with whom we have a business relationship (e.g., medical publishers, professional websites or similar parties).

  • We may capture certain information automatically on our websites or through the websites of others, including your Internet protocol (IP) address, mobile device identification number, browser type, page access history, user agent strings, linking information, click stream data, page visits, page views, web site log files, and/or geolocation data.

  • We may use cookies, pixels, log files, clear gifs, and/or similar devices to identify you or your device, to keep track of your interactions with websites (including ours and those of our partners and affiliates), and to and enhance certain activities available on any such website. These devices are small text or other electronic files that are used for user-identification purposes, record-keeping purposes, and to increase the ease of use of the websites or other applications. We may use persistent or not-persistent cookies. You can remove or reject persistent cookies by following the directions provided in your Internet browser’s “help” file. If you remove a persistent cookie or reject persistent cookies, the functionality of our websites, or any part thereof, may be impaired or unavailable.

  • We may combine information we receive through one source/method with information already in our possession, made available to us or obtained by us through another source, which may be online or off-line.

Please note that, in the event and to the extent we receive personal information from third parties (e.g. publishers or associations), such information is also subject to the privacy policies of the applicable third party. We urge you to review such third party privacy policies.  We are not responsible for the actions of any third party that collects information from you and provides it to us for our use.

Information Use

We may use the information we collect in the following ways:

  • To contact you with professionally relevant information about products and services.

  • To provide you with personalized offers, promotions, news, events, and other information we or our clients believe are relevant to your practice.

  • To administer a contest, promotion, survey, or other feature.

  • To establish and maintain customer accounts.

  • To quickly process your requests for information.

  • To allow us to respond efficiently to your questions.

  • To monitor Web site statistics.

  • To monitor our customer service employees.

  • To share your response information to email communications with the sponsor(s) of the professionally relevant program with which you interact.

  • To allow us to disclose your information to the extent permitted by law, in the situations described more fully below.

Information Protection

We have established and implemented reasonable physical, electronic, and administrative procedures designed to safeguard and secure the personal information we collect and maintain. Nevertheless, we cannot guarantee the security of that information.

Information Disclosure

We license the use of our databases to third parties so that they can contact you for professionally relevant reasons and/or provide you with professionally relevant content or marketing material. We will send you professionally relevant information on behalf of third parties. Each email you receive from us will include instructions on how to be removed from our promotional email list. 

In some circumstances, we will allow a third party to have access to our databases for the purposes of data analytics, to contact you, or to provide you with information for marketing or other purposes. We will allow this access only when the third party has agreed to abide by our list use or other relevant agreement limiting use consistent with our policy, as well as any additional restrictions such as those set forth by the AMA or list or database owner regarding the use of their Master File.

Finally, there are certain circumstances wherein your information may be disclosed to or accessible by a third party. These circumstances include:

  • Subsidiaries and Affiliates. We may transfer personal information to our subsidiaries and corporate affiliates.

  • Consultants and Service Providers. We may disclose personal information to third party consultants and service providers (such as providers of hosting and email deployment, support, disaster recovery and/or back-ups, maintenance; third party payment processing agencies; and remedial and repair services) to the extent that they require access to our databases, or the information contained in our databases, in order to perform services for us.

  • Enforcement of Rights/Security. We reserve the right to release personal information (i) when we are under legal compulsion to do so (e.g. we have received a subpoena) or we otherwise believe that the law requires or permits us to do so in connection with a legal matter or proceeding, (ii) when we believe it is necessary to protect and/or enforce the rights, property interests, or safety of the Company, our users or others, or (iii) as we deem necessary to resolve disputes, troubleshoot problems, prevent fraud and otherwise enforce the Privacy Statement and/or other agreements.

  • Reorganization or Sale of the Company. In the event that the Company is merged with or becomes part of another organization, or in the event that Company is sold or it sells all or substantially all of its assets or is otherwise reorganized, the information we possess  will be one of the transferred assets to the acquiring or reorganized entity.

  • As Otherwise Allowed by Law. We may transfer personal information to third parties where we are expressly authorized by applicable law to do so.

  • Aggregated Information. We may aggregate information that we receive with information provided by other individuals/sources, and we may transfer that aggregated information to third parties.

Access/Modify/Restrict Information

You may contact us to access, update and/or restrict use of your personal information consistent with applicable law (see contact information below).   We may ask you for additional information to authenticate your request.

International Citizens

We provide services intended for US-based medical professionals only.   We do not knowingly send communications to, or track web activity for, non-US based medical professionals, and utilize reasonable measures, including technical measures, which are designed to identify recipients who are located outside of the US.  However, in the event you are a non-US citizen you consent to the processing of your personal information in accordance with this privacy policy.

Acceptance of Terms

By using our websites, products or services, you signify your acceptance of the terms of our Privacy Policy. If you do not agree to the terms of our Privacy Policy, please do not use the website, products and/or services, and exit these sites immediately.

Notice to California Residents— Your California Privacy Rights:

Pursuant to California law, California residents, may request from us information concerning: the categories of information we have collected; the categories of sources from which the personal information is collected; the purpose for which we collect or sell the personal information; the categories of third parties with whom we share personal information; and the specific pieces of personal information we have collected.    You also have the right to ask us to delete the personal information we maintain regarding you. We will not discriminate against you for exercising any of these rights.
